Patent rights
are rights allowed to a person for a new invention, process of invention or
modification of any existing invention. In UK,
it is the UK
intellectual property office (UK-IPO) that grants patents. The patent right is
usually granted for a period of twenty years.
The first thing
to be done before filing the application is to check whether there are any
existing patents for your invention. There are also some conditions that have
to be satisfied for your invention to be patentable. They are it must be new
and should have been kept secretive. This means that it must no be disclosed to
the public. It should be a new invention and not be something that is already
known. It must also be something useful either in any industry or elsewhere.
Next step is
filing of the application. This can be done by either the inventor himself or
by any lawyer authorized by the inventor. First an initial application has to
be filed. This has to be done when before the invention is made and also before
the invention is made public. This will help to give protection up to one year.
Next a formal application has to be filed on the expiry of one year. If any
improvements have been made to the invention, then it can be included in this
application. Also in this application, the date of filing can be claimed. The
application should also consist of the inventor’s name, the request for getting
a patent and an explanation of the patent with drawings if any. The search
report will be issued by the patent office in around three months time. Also in
another three months time, the application will be published. Within six months
of the application the fees and request for examination. The UK intellectual
property office (UK-IPO) will raise the objections if any during this time to
which the inventor will have to reply. If they are satisfied, then the patent
will be granted. If the patent is granted then it will be published in the UK
intellectual property office’s official journal.
The process of getting a patent usually takes
around four years. It will have to be renewed from time to time by paying the
necessary fees.
